Terms of Service

These Terms of Service (“Terms”) govern your use of the CapyCents mobile app and the website at capycents.me (together, the “Service”), provided by Fausto Genga, based in Belgium (“we”, “us”). By using the Service you agree to these Terms. If you don’t agree, please don’t use the Service.

1. What CapyCents is

CapyCents is a personal-finance tool that helps you track spending, budget, and view your accounts in one place. Where you choose to connect a bank, CapyCents reads your transactions on a read-only basis through a regulated Open Banking provider. CapyCents is not a bank, is not a payment service, and never moves, holds, or transfers your money.

2. Eligibility

You must be at least 16 years old (the GDPR age of consent in Belgium) to use the Service.

3. Your account

CapyCents creates an anonymous account for you on first launch; you may optionally link it via Sign in with Apple. You are responsible for the device and credentials used to access your account. Tell us promptly if you believe your account has been compromised.

4. Connecting a bank (Open Banking)

If you connect a bank account:

• You authorise access directly with your bank using its own secure login. We never see your bank credentials.
• Access is read-only (Account Information Service, AISP, under PSD2). We cannot initiate payments or move funds.
• You can revoke access at any time, in the app or via your bank. Bank authorisation expires at least every 90 days and must be renewed to keep syncing.
• Open Banking access is provided through our partner Enable Banking Oy and is also subject to your bank’s and Enable Banking’s terms.

5. Accuracy of information

CapyCents shows information sourced from you, your bank, and your bank’s notification emails. We work to keep imports accurate and de-duplicated, but we don’t guarantee that every transaction, balance, or category is complete or error-free. CapyCents does not provide financial, tax, investment, or legal advice. Always treat your bank’s own records as authoritative, and make financial decisions based on them.

6. Acceptable use

You agree not to:

• Use the Service unlawfully or to access data that isn’t yours.
• Reverse-engineer, disrupt, overload, or attempt to breach the Service or its providers.
• Resell or commercially exploit the Service without our written permission.

7. Your data

Our handling of your data is described in the Privacy Policy, which forms part of these Terms. You can export or permanently delete your data at any time — see Delete your data.

8. Availability and changes

The Service is provided on an “as is” and “as available” basis. We may add, change, suspend, or discontinue features at any time. We may update these Terms; material changes will be posted here with a revised “Last updated” date, and your continued use after that constitutes acceptance.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any financial loss arising from your reliance on information shown in the Service. Nothing in these Terms limits liability that cannot be limited under Belgian or EU law (including for fraud or for death or personal injury caused by negligence). Because CapyCents currently ships free of charge, our aggregate liability is limited accordingly.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to comply with the law.

11. Governing law

These Terms are governed by the laws of Belgium, and the courts of Belgium have jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence.
